Supreme Court of Arkansas to hear arguments against anti-gay sodomy law

 

A news released published today by the Lambda Legal reports that the Arkansas Supreme Court will hear oral arguments in Jegley v.Picado in which Lambda Legal Defense and Education Fund (Lambda Legal) is representing seven Arkansas residents challenging the state's same-sex-only sodomy law, which they argue violates their constitutional rights to privacy and equal protection.

In March 2001, an Arkansas state circuit court overturned the

state's anti-gay sodomy law, ruling that it is unconstitutional for the state to ban consensual sex for adult same-sex couples. The court held that the law violated the state's constitutional right to privacy and equal protection. The state appealed that decision.

The Arkansas Supreme Court will hear oral argument from plaintiffs' attorneys and also from the Office of the Attorney General of Arkansas.
